By accessing or using Little C (the "Service," "Little C," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and the operator of Little C. By creating an account, accessing the Service through our website or mobile application, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
We may update these Terms from time to time. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
Little C is an AI-powered breast cancer care companion application designed to help users organize, track, and better understand their breast cancer care journey. The Service may include features such as:
Little C is NOT a medical device. Little C is NOT a diagnostic tool. Little C does NOT provide medical advice, diagnosis, or treatment recommendations. The Service is designed solely as an informational and organizational companion to support users alongside — never as a replacement for — professional medical care.
You must be at least 18 years of age to create an account and use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using the Service, you represent and warrant that you meet the applicable age requirements and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of another person (such as a family member or patient), you represent that you have the authority to accept these Terms on their behalf and that they consent to your use of the Service in connection with their care.
We reserve the right to request verification of age or guardian consent at any time and to suspend or terminate accounts that do not meet eligibility requirements.

You may not share your account credentials with any other person, create multiple accounts, or use another person's account without permission. You may not use the Service for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Service.
Little C reserves the right to suspend or terminate your account if we reasonably believe that you have violated these Terms or engaged in fraudulent or abusive activity.

LITTLE C IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO BE USED AS ONE. THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. NOTHING CONTAINED IN THE SERVICE SHOULD BE CONSTRUED AS MEDICAL ADVICE OR A RECOMMENDATION FOR ANY SPECIFIC TREATMENT, MEDICATION, OR COURSE OF ACTION.
THE INFORMATION PROVIDED THROUGH THE SERVICE — INCLUDING AI-GENERATED CONTENT, EDUCATIONAL MATERIALS, SYMPTOM TRACKING SUMMARIES, AND ANY OTHER CONTENT — IS FOR INFORMATIONAL AND ORGANIZATIONAL PURPOSES ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT FROM A QUALIFIED HEALTHCARE PROVIDER.
YOU SHOULD ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ OR RECEIVED THROUGH THE SERVICE.

RELIANCE ON ANY INFORMATION PROVIDED BY THE SERVICE, ITS AI FEATURES, OR OTHER USERS OF THE SERVICE IS SOLELY AT YOUR OWN RISK.
Little C uses artificial intelligence technologies, including large language models, to power certain features of the Service. You acknowledge and agree that:
Little C expressly disclaims any liability arising from your reliance on AI-generated content provided through the Service.
The Service, including its original content, features, functionality, design, code, graphics, logos, and trademarks, is and will remain the exclusive property of Little C and its licensors. The Service is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
"Little C" and associated logos and marks are trademarks of Little C. You may not use these marks without our prior written consent.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms. This license does not include the right to:
You retain ownership of any content you submit, upload, or input into the Service ("User Content"), including health data, documents, notes, and conversation inputs. By submitting User Content, you grant Little C a limited, non-exclusive license to process, store, and display your User Content solely for the purpose of providing and improving the Service for you.
We do not sell your personal or health information. Third-party service providers, including AI providers, process User Content to operate the Service. Content you choose to share through caregiver, community, or public-page features is also disclosed to the relevant recipients. Our Privacy Policy describes these disclosures, provider processing, and disclosures for legal and safety reasons.
You are solely responsible for the accuracy and legality of your User Content. You represent that you have the right to submit all User Content you provide and that your User Content does not violate any third party's rights.
Data export and account deletion are available in Settings. Deletion and retention are described in our Privacy Policy; deleting your account does not recall copies you have shared with other people.
The Service integrates with and relies upon third-party services to deliver its functionality. These third-party services include, but are not limited to:
Your use of the Service is also subject to the terms and policies of these third-party providers to the extent applicable. We select our third-party partners carefully and require them to maintain appropriate security and privacy standards, but we are not responsible for the practices, policies, or availability of any third-party services.
The Service may contain links to third-party websites or resources. We do not endorse and are not responsible for the content, products, or services offered by third parties. Your interactions with third-party services are solely between you and the third party.
We may change, add, or remove third-party service providers at any time to improve the Service or for operational reasons.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LITTLE C, ITS OPERATOR, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF LITTLE C FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LITTLE C IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Little C, its operator, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

You may terminate your account at any time by using the account deletion feature in the Service's settings or by contacting us at legal@littlec.health. Upon termination, your right to use the Service will immediately cease.
Little C may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:
Upon termination, we will delete your account data in accordance with our Privacy Policy and applicable data retention obligations. Certain provisions of these Terms shall survive termination, including Sections 5 (Medical Disclaimer), 6 (AI-Powered Features Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), and 14 (Governing Law).
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the Service (such as an in-app notification), by email to the address associated with your account, or by posting a prominent notice on our website.
Changes will become effective on the date specified in the notice, which will be no sooner than 30 days after the notice is provided for material changes. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service and may delete your account. We encourage you to review these Terms periodically to stay informed about our terms and conditions.
We will maintain an archive of previous versions of these Terms, available upon request at legal@littlec.health.
These Terms shall be governed by and construed in accordance with the laws of the State of [YOUR STATE], United States, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, to be conducted remotely or at another location mutually agreed by the parties.
YOU AND LITTLE C AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of that party's intellectual property rights.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permitted by law.
